Article 1. Definitions
In these Terms & Conditions, the following definitions apply:
Sunæ: the company as described in Article 2 of these Terms & Conditions.
Customer: the consumer or business customer entering into an agreement with Sunæ or negotiating such an agreement.
Consumer: an individual acting outside their professional or business activities.
Agreement: any agreement concluded between Sunæ and the Customer through the webshop.
Parties: Sunæ and the Customer jointly or individually.
Written: communication through email or other digital communication methods that can be stored.
Third Party: any natural person or legal entity that is not part of the agreement between Sunæ and the Customer.
Product(s): all products offered by Sunæ through the webshop, including clothing, accessories, and related lifestyle items.
Website/Webshop: the official online store of Sunæ.

Article 3. General Provisions
These Terms & Conditions apply to every offer made by Sunæ and every agreement concluded through the webshop.
The Terms & Conditions are made available electronically before the agreement is concluded and can be stored by the Customer.
Any deviations from these Terms & Conditions are only valid if agreed upon in writing with Sunæ.
If any provision of these Terms & Conditions is declared invalid or unenforceable, the remaining provisions will remain fully applicable.
Sunæ reserves the right to involve third parties in the execution of agreements.
Article 4. The Offer
All products are offered subject to availability.
Sunæ takes great care in presenting products as accurately as possible. Minor differences in color, material, or appearance may occur due to screen settings or production processes.
Obvious errors or mistakes in product information do not bind Sunæ.
Promotions and offers may be changed or withdrawn at any time.
Article 5. The Agreement
The agreement is concluded once the order process has been completed and payment has been successfully authorized.
The Customer will receive an order confirmation by email.
Sunæ takes appropriate measures to ensure secure electronic transactions.
Sunæ reserves the right to refuse orders when there is reasonable doubt regarding the accuracy of information provided or the fulfillment of the agreement.
Article 6. Right of Withdrawal
Consumers have the right to withdraw from the agreement within 14 days after receiving the product without providing a reason.
The right of withdrawal only applies to consumers.
Products must be returned unworn, unwashed, and in their original condition.
Returns must be registered in advance through the return portal on the website.
Return shipping costs are the responsibility of the Customer unless stated otherwise.
Refunds will be issued within 14 days after Sunæ has received and inspected the returned product.
Article 7. Customer Obligations
The Customer is responsible for providing accurate and complete information when placing an order.
Any damage or delay resulting from incorrect information provided by the Customer will be the Customer’s responsibility.
Article 8. Liability
Sunæ is only liable for direct damages resulting from an attributable failure to perform its obligations.
Sunæ’s liability is limited to the value of the relevant order.
Sunæ is not liable for indirect damages, consequential damages, or damages caused by circumstances beyond its control.
Article 9. Force Majeure
If Sunæ is unable to fulfill its obligations due to circumstances beyond its reasonable control, this shall be considered force majeure.
Force majeure includes all circumstances that cannot reasonably be attributed to Sunæ.
Article 10. Complaints
Complaints should be submitted as soon as possible, preferably within 48 hours after receiving the product, via:
Sunæ will carefully review every complaint and work towards an appropriate solution.
Article 11. Intellectual Property
All intellectual property rights relating to the website, designs, texts, images, branding, and products of Sunæ belong exclusively to Sunæ.
Use of Sunæ materials without prior written permission is not permitted.
Article 12. Applicable Law
All agreements between Sunæ and the Customer are governed exclusively by Dutch law.
Article 13. Changes
Sunæ reserves the right to update these Terms & Conditions.
